This website is operated by Luma Treasures. These Terms of Service (“Terms”) apply to all customers, including retail customers and business (B2B) customers such as retailers, wholesalers, and event businesses. By accessing our website or placing an order, you agree to be bound by these Terms.

Australian Consumer Law (ACL)

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law that cannot lawfully be excluded, restricted, or modified.

Retail vs Business Customers

Retail customers are protected under the standard consumer guarantees of the ACL.

Business (B2B) customers agree that purchases are made for commercial purposes and may be subject to additional limitations set out in these Terms and in our Return & Refund Policy.

Orders & Acceptance

All orders are subject to acceptance by Luma Treasures. We reserve the right to:

• Refuse or cancel any order at our discretion
• Limit order quantities
• Cancel orders where a pricing or listing error has occurred

If we cancel an order after payment, you will receive a full refund.

Pricing & Payment

All prices are in Australian dollars (AUD) and include GST unless stated otherwise. Prices are subject to change without notice, but changes will not affect orders already accepted.

For B2B customers:

• Payment must be made in full before dispatch unless credit terms have been agreed in writing
• Late payments may incur reasonable fees or interest
• We reserve the right to suspend supply while invoices remain unpaid

Product Nature & Descriptions

We take care to display our products accurately, but colours may appear differently depending on your screen. Where products are handmade or made from natural materials, minor variations in:

• Colour
• Texture
• Shape and size

are normal characteristics of the product and do not constitute defects.

Product Use & Care

Once delivered, the customer is responsible for proper storage, care, and use of products in line with any care instructions provided. Luma Treasures is not liable for damage caused by misuse, improper storage, or failure to follow care instructions.

Returns & Refunds

All returns and refunds are governed by our Return & Refund Policy, available on our website. For B2B orders, change-of-mind returns are not accepted; only faulty or non-compliant goods are eligible for return.

Delivery & Risk

Delivery is governed by our Shipping Policy. Risk in the goods transfers to the customer upon delivery. Luma Treasures is not responsible for:

• Delays caused by carriers or events outside our control
• Loss or damage occurring after delivery

Website Use

You agree not to misuse our website, including by attempting to gain unauthorised access, introducing malicious code, scraping content, or using the site for any unlawful purpose.

Limitation of Liability

To the maximum extent permitted by law:

• Luma Treasures is not liable for indirect, incidental, or consequential losses
• Our total liability is limited to the replacement of the goods, the supply of equivalent goods, or a refund of the price paid

This limitation does not apply to liability that cannot be excluded under the ACL.

Indemnity

You agree to indemnify Luma Treasures against claims arising from your misuse of products, breach of these Terms, or unlawful resale or commercial use of our goods.

Intellectual Property

All branding, product designs, images, text, and other content on our website remain the property of Luma Treasures (or our licensors) and may not be reproduced without our written permission.

Termination

We may suspend or terminate your access to our website or refuse future orders if these Terms are breached.

Governing Law

These Terms are governed by the laws of Victoria, Australia, and you submit to the non-exclusive jurisdiction of the courts of Victoria.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on our website with a revised “Last updated” date. Continued use of the website indicates acceptance of the updated Terms.
